BRACKENBRIDGE TERMS AND CONDITIONS
- Owner identification and general information
BRACKEN BRIDGE is the trade name of the company Bracken bridge, S.L. These Terms and Conditions govern access to and use of the website www.brackenbridge.com (the "Website"), owned by Bracken bridge, S.L. ("Brackenbridge"), with tax ID (C.I.F.) B-86234101 and registered office at Parque Tecnológico y Logístico de Valladares, Área TexVigo, Calle C s/n – Edificio Dotacional, 36315 Vigo (Pontevedra), Spain, as well as the services and products offered by Bracken bridge on its Website.
Bracken bridge offers this Website subject to these Terms and Conditions. By visiting the Website or using its services or applications, the user accepts these Terms and Conditions.
Users do not need to register to access the Website. However, to purchase any of the services offered by Bracken bridge, the User must register and accept these conditions before completing payment.
Through the Website, Bracken bridge offers Users textile garments under the Bracken bridge brand.
These Bracken bridge Terms and Conditions set out the rights and obligations of Bracken bridge and Users in relation to the Website. They are the only Terms and Conditions applicable to the use of the Website (notwithstanding any specific conditions that may apply to certain services) and to orders placed through the Website, and they replace any other conditions unless otherwise agreed in writing between Bracken bridge and the User.
- User data and conduct on the Website
To purchase the products offered on the Website, the User must register using the registration form available on the Website.
The User is responsible for keeping the data and information provided confidential and for restricting access to their computer and passwords to prevent unauthorised use.
If the User has reason to believe that their data has been disclosed to a third party, or has been or may be used without authorisation, they must inform Brackenbridge immediately.
The User must check that their data is correct and complete and inform Brackenbridge of any change to the information provided during the purchase process.
Brackenbridge reserves the right, at its discretion, to refuse any attempt to access the Website, to remove or modify content, or to cancel orders. The Website may not be used for fraudulent purposes or in connection with criminal offences or unlawful activities of any kind.
It is also prohibited to send, use or reuse any illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or material that infringes copyright, trademarks, confidentiality, privacy or any other right, or that is otherwise harmful or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising, chain letters, mass mailings or any other form of "spam" and, in general, any unnecessary nuisance or inconvenience.
- Orders and conditions of sale
The services and products offered through the Brackenbridge Website are intended for the purchase by Users of textile garments under the Brackenbridge brand.
To place an order with Brackenbridge, the User must be over 18 years of age.
From the Website www.brackenbridge.com, Brackenbridge ships orders worldwide.
To place orders through the Website, the User must provide certain information before purchase via the order form, which is needed to process the order.
- Price, payment and discount codes
Once the form has been completed, the User must pay for the order using the payment methods specified on the Website.
After payment, the User will receive an order confirmation email including a summary of the items purchased, the shipping method chosen and the delivery address.
If a problem prevents payment from being made, the User will receive an automatic payment error message and the order will not be processed until payment has been completed successfully.
Prices are shown in Euros (€), US Dollars ($) and Pounds Sterling (£), including taxes and handling and shipping costs, the amount of which will be shown when each order is finally confirmed.
All shipments outside the European Union are exempt from VAT and are therefore subject to the import duties and customs charges set by the destination country, which are payable by the recipient. Customers must ensure that the items purchased are not subject to customs restrictions in their country, as Brackenbridge accepts no liability if an order is held at customs for this reason.
Brackenbridge may periodically offer discount codes to its Users. These discounts may only be applied in accordance with the instructions specified by Brackenbridge for each code, and Users may only use one code per order.
- Information about Brackenbridge products and services
The information on the Website in each product and service description, photograph, graphic or iconographic representation or video, as well as trade names, trademarks or distinctive signs of any kind, is for information purposes only. Brackenbridge therefore accepts no liability for any errors in such information, although it undertakes to take all reasonable steps to correct any such errors or omissions as quickly as possible after being informed of them.
- Returns and right of withdrawal
6.1 Returns due to manufacturing defects.
The User may return to Brackenbridge, free of charge, any product with a manufacturing defect. To arrange the return, the User must contact Brackenbridge at contact@brackenbridge.com, stating the product(s) to be returned and attaching a photograph and a detailed description of the defects observed. On receipt, Brackenbridge will tell the User, where appropriate, how the defective product will be collected or sent to its warehouse, at no cost to the User. Each product returned must be unused and have all its original labels, packaging and, where applicable, documentation and accessories. If this is not the case, Brackenbridge reserves the right to refuse the return. Once the product has been received and the defect confirmed, Brackenbridge will send a replacement product with identical characteristics, also at no cost to the User.
If a replacement with identical characteristics cannot be sent due to lack of stock, the amounts paid for the returned product will be refunded as soon as possible and, in any event, within fourteen (14) days.
6.2 Right of withdrawal.
If the User is not satisfied with the products received, under the Spanish General Law for the Protection of Consumers and Users the User has fourteen (14) calendar days to return them, without penalty and without giving any reason, although the User must bear the direct cost of returning the order to Brackenbridge. To arrange the return, the User must contact Brackenbridge at contact@brackenbridge.com and send the completed withdrawal form attached to these Terms and Conditions as ANNEX 1. On receipt, Brackenbridge will explain how to send the order to its warehouse; the items must be unused and have all their original labels, packaging and, where applicable, documentation and accessories. If this is not the case, Brackenbridge reserves the right to refuse the return. Amounts paid will be refunded as soon as possible and, in any event, within fourteen (14) days of the date on which the User notified their decision to withdraw from the contract.
Product exchange policy
Brackenbridge does not accept exchanges of a product purchased by the User for another product offered on the Website. If the User wishes to exchange a product, they must exercise their right of withdrawal in accordance with clause 6.2 and then purchase the new product they want.
- Use of the Website
The Website may not be used for fraudulent purposes or in connection with criminal offences or unlawful activities of any kind.
It is also prohibited to send, use or reuse any illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or material that infringes intellectual property rights, trademarks, confidentiality, privacy or any other right, or that is otherwise harmful or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising, chain letters, mass mailings or any other form of "spam" and, in general, any unnecessary nuisance or inconvenience.
The User undertakes to make lawful, diligent, honest and proper use of all information or content accessed through the Website or through third-party websites reached via links on the Website, acting in good faith and in compliance with applicable law at all times.
The User may access the information on the Website (meaning any message, sound file, photograph, drawing, software and, in general, any kind of computer or graphic file) for personal use only.
The User also undertakes not to maliciously or intentionally cause damage that may impair or alter the Website, and not to introduce or spread computer viruses that may cause unauthorised alterations to the content or systems of the Website.
- Intellectual and industrial property
The intellectual property rights to www.brackenbridge.com, its source code, design, navigation structures and the various elements it contains belong to Brackenbridge, which has the exclusive right to exploit them in any form and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with applicable Spanish and European law.
Brackenbridge grants no express or implied licence or authorisation over intellectual and/or industrial property rights or any other right or property related, directly or indirectly, to the content of the Website. Total or partial reproduction of the content of the Website, even by means of a hyperlink, is strictly prohibited without the express written consent of Brackenbridge. Unauthorised use of this content will give rise to the liabilities established by law.
- Hyperlinks
Hyperlinks on the Website may lead to third-party websites. Brackenbridge accepts no liability for the content, information or services that may appear on those sites, which are provided by Brackenbridge for information purposes only and in no case imply any relationship, acceptance or endorsement between Brackenbridge and the persons or entities that own such content or sites.
- Partial invalidity
If any clause of these Terms and Conditions is declared invalid, the remaining clauses will remain in force and will be interpreted in keeping with the spirit of these Terms and Conditions.
- Changes
The information on this Website is current as of the date of its last update. Brackenbridge reserves the right to unilaterally modify these Terms and Conditions, its privacy policy and any other information. Changes to the Terms and Conditions take effect from the moment they are published on this Website.
- Notices
All communications between Brackenbridge and the User regarding orders placed through the Website will be made in writing, in accordance with the communication procedures set out in these Terms and Conditions for each case.
- Language
Brackenbridge may translate these Terms and Conditions, its Privacy Policy or any other operating rule, policy or procedure published on the Website. In the event of any conflict, the Spanish version will prevail.
- Ethical supplier policy
As a reputable and reliable company committed to providing high-quality products to its customers, Brackenbridge recognises its obligation to ensure that its suppliers act ethically. We expect our suppliers to consistently provide an environment that protects the health and safety of their employees, as well as their basic human rights. All suppliers must comply with their national employment laws and regulations, in particular with regard to:
- Minimum working age
- Freely chosen employment
- Health and safety
- Freedom of association and the right to collective bargaining
- Non-discrimination
- No harsh or inhumane treatment
- Working hours
- Wages
- Working conditions
Brackenbridge will never knowingly source supplies from countries that breach these principles. We also expect our suppliers to apply these principles in their dealings with their own suppliers. Because of the sometimes complex nature of our suppliers' supply chains, it is not always possible to monitor and control the conditions of every individual involved in making our products. However, as Brackenbridge continues to grow, it recognises the importance of taking the initiative and doing everything possible to uphold the rights of the people involved in making its products.
- Governing law and jurisdiction
These Terms and Conditions are governed by Spanish law. In accordance with Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, the parties submit to the Courts and Tribunals of the User's place of residence.
